Personal and public liability insurance – Is it possible to get a combined policy? I’m about to set up a small sole trader business in the UK making furniture and I am going to be moving into a small industrial unit which I will be renting. I have been advised by the people who are renting out the unit that I need to get personal and public liability insurance. I have done a few searches on the internet but I can’t see any companies that have a combined policy. In other words it seems I have to get two seperate insurance policies for personal and public insurance. Is this right? Or is it the case that public liability also includes personal liability.
OK, I filter to US Only questions (not english only) and this came up, so I’m guessing that maybe you’re not going to get many UK answers. Here in the US, and most of the rest of the world, it’s true – there are TWO different kinds of liability – personal, and business. “Public” is a misnomer – public can be either personal, or business. Or maybe it’s just a UK way to say ‘business’. But, you CANNOT combine the two. The rating basis and coverages are WILDLY divergent. Business liability does NOT include personal liability, but it DOES extend coverage, to some extent, over employees IN THE COURSE OF EMPLOYMENT. With exclusions, of course.
Normally you get two separate policies. But this should not be a big deal.
Can a life insurance company cancel a policy within the first two years of inception if suicide is suspected? My friend has a term life insurance policy that is less than 2 years old. She entered the hospital recently for a newly diagnosed bipolar disorder and had admitted to thoughts of suicide. Within 2 months of her stay and diagnosis, her term life insurance policy was canceled by the insurance company for reasons of risk. Can they legally do this? I read the policy, but am unclear whether they have the right to do this. Thanks.
They can not cancel the policy if they suspect someone has become suicidal after the policy is issued. But, and this is a big but, if they have evidence that the person was suicidal before the policy was applied for and withheld that information the company has the right to rescind the contract. For example if your friend was already receiving psychiatric care and did not disclose that on the application that would be grounds to rescind the contract. A rescission of a legal contract is technically not a cancellation but is instead the unmaking of the contract bringing the parties to the position they were before the contract was entered into..
they can cancel any policy with in two years or you keep paying and tell you that they don’t pay on death withing two years. it will cost but its best for you protection to paid a lawyer to get an life insurance policy for you that way you know you protected
Life insurance does NOT pay a benefit when the cause of death is suicide. A suicide exclusion is written into every life insurance policy.
Most Life Insurance contracts have a two year “contestable” period. Any suicide during the first two year period will result in a refund of the premiums paid and no death benefit paid. After the policy has been in force for two years, a death benefit will be paid even in cases of suicide.
Somethings about this story is not clear. How did the insurance company find out about the mental disorder? As long as the customer did not lie on the application there would not be a cancellation even if something came up later. The insurance company could refuse to pay if there was a death by suicide within the first 2 years of the policy. Are you sure that maybe your friend just didn’t forget to pay the premiums? You might call the Department of Insurance in your state for help. And, you might consider getting your friend a power of attorney to handle health and personal matters until they get better.
The insurance policy company is obligated to pay the proceeds to the beneficiaries listed on the policy regardless of what the will says. His attorney should have explained that to your father-in-law (and probably did). Perhaps the attorney believed that your Father-in-Law was going to change the beneficiaries or perhaps that was your Father-in-Law’s intention but if he didn’t change the beneficiaries before his death, then the original beneficiaries stand.
No. Beneficiaries take precedence over a will.
concys, I’m not a lawyer, and that’s probably what you need. My understanding is that the will distributes assets separately from the insurance policy. If he did not change the policy, the recipients named in it are the ones who get the pay-out. But really, it’s worth a phone call to an attorney. Find one who does estate planning; he or she will know this stuff cold.
Unless the policy went to the estate the life insurance goes to whoever is listed as the beneficiary, The Will and the insurance are two different things.
OK, are you talking about the COMPANY that closed, or the AGENCY? It’s crucial. If your policy is through an admitted carrier in your state, and the company really did go under, there’s a state fund to pay claims for the bankrupt company. Your state insurance department will be able to give you more info.
DO A COMPUTER SEARCH ON THAT COMPANY NAME. IT SHOULD SHOW WHICH COMPANY NOW HAS THOSE RECORDS AND RESPONSIBILITY.
they probably transfer ed your policy to another company. Many companies will sell the policy to another when they close down. Check it out
I would start by contacting your state insurance board….they will be able to help you and investigate the issue.
I’d advise that you give the OK Department of Insurance a call first, since the policy was issued there. Since the company was a licensed entity, the OK-DOI should be able to tell you if the company’s business was purchased by another company or not. If it wasn’t, ask the DOI for the telephone number of the OK Life and Health Guarantee Corporation (this is not a state fund, as another answerer wrote, but a private corporation). Call the Guarantee Corporation and have them explain your rights. Depending upon OK law at the time the policy was issued, there may also be a one or two page notice in the policy that explains about the Guarantee Corporation; this has been the law in my state for at least 30 years. I hope this helps. Please let me know if you have any further questions.
This is a very frustrating situation. I ran into a similar problem as the executor of my father’s estate. It took persistence and a lot of time (phone calls, letters, etc.), but I finally collected on an old policy he had bought back in the 40s, despite the fact that the companies over the years had closed and/or changed multiple times. The State Commissioner of Insurance is definitely the best place to start, and they should be able to advise you as to where to go and what to do next. Stick with it! Good luck!
Would a will and life insurance policy be valid in a different state? If I make a will and a life insurance policy in Florida, would both of them be valid in Hawaii or would I need to update it? Sources?
The life insurance policy would be fine. You should check with a lawyer to see if the will is valid in Hawaii. States have different laws and rules about what makes a valid will.
Can i start insurance on a new car with a new insurance provider before the current policy runs out ? My current car insurance policy runs out at the end of the month and I will not be renewing with them. I am getting a new car approx 2 weeks before the expiry date. Can i start the insurance with another company and ‘overlap’ the insurance ?
You certainly could. I’ve done it twice and my insurance company was ok with it.
You CAN do that since you are changing anyway. You might want to notify your PRIOR insurance company once you have the NEW coverage in force – just to avoid any duplication of coverage and any “earned premium.” If the company automatically renews and you don’t inform them, they might try to collect for the time you had coverage in force. Just show them a copy of your NEW policy and they will cancel the old. That’s the way it SHOULD be done. Good luck, drive RESPONSIBLY and I hope this helps!
